6 Obligation It is an obligation of food business operator to register and obtian food license before dealing with food products
7 Applicability / Eligibility All food business operators are eligible to obtain this license
8 Validity A Food license can be applied for a maximum period of 5 Years and also can be applied a period less than 5 years (Such as 1 year, 2 Years / 3 Years / 4 Years / 5 Years)
9 Forms An application for license to applied in Form – B through online portal.
10 Amendments  / Renewal / Surrender Amendments / Modification A Food license can be ammended for the following puposes with payment of nominal Fee: 1. Company basic details (such as address, phone number, email id etc.) 2. Inclusion / exclusion of food item 3. Production capacity details 4. Person responsible for operations and others. Renewal – An application for renewal of existing Food license has to submitted with respective department not earlier than 180 days but not less than 30 days prior to expiry date. – Renewal fee is same as fresh license. Surrender A food business operator can surrender their existing license in case of discontinuous of business.
11 Government Fee Fresh Licenses Basic / Registration: Rs. 100 per year State License : Rs. 2,000 to 5,000 per year depends on production capacity & Turnovers Central License : Rs. 7,500 per Year Renewal Same as Fresh License
12 Penalty for Non-Compliance / Other Provisions / Guidelines 1. Penalty for Sale of Food Items without valid Food License : Upto Rs. 5 (and / or) Imprisonment 2. Penalty for Non Renewal within Due Dates: i) Three times of the existing annual license/registration fee in the period – 1st day to 90th day from the original expiry date. ii) Additional two times of the existing annual license/registration fee (i.e. total 5 times) in the period – 91st day to 180th day from the original expiry date

14 Checklist Manufacturers 1. Production unit photographs 2. Blueprint / layout plan of the processing unit 3. List of Directors/Partners/Proprietor with contact Details 4. Name and List of Equipment’s and Machinery along with the number 5. Photo I.D and address proof issued by Government authority of Proprietor/Partner/Director(s)/Authorized Signatory. 6. Proof of possession of premises (Electricity Bill & Rental Agreement/Lease Deed/Sale Deed) 7. Certificate of Incorporation, MOA & AOA (Companies) / Partnership Deed (Partnership Deed) 8. FAQ

Are different Licenses required to conduct different kind of food business activities at the same premise?
FSSAI license is based on premise. All kinds of food business activities which are being conducted at the same premise can be applied for in a single FSSAI license.

How to convert manually issued licenses/ registration to online during renewal of license?
FBO can approach the Designated Officer [Licensing Authority] or Registering Authority of that area Designated Officer/ Registering Authority will enter the details of the offline issued license / registration in the FoSCoS portal. Thereafter, the license/registration can be renewed through online process, whenever required.

My License/Registration is suspended or cancelled. Do I need to stop food business activities?

On the suspension or cancellation of his/her License or registration, a food business operator needs to stop food business activities immediately. Carrying out any food business activity on suspended or cancelled License/Registration is an unlawful activity and shall attract penal actions under FSS Act, 2006.

Do I need to obtain FSSAI License for utensils/packaging material meant for serving or packaging of food?
No. FSSAI License/Registration is not required for utensils or packaging material as these are not covered under the definition of food as per Section 3(n) of FSS Act, 2006.

My License was cancelled. Can I apply for fresh License?

After a period of 3 months from the date of cancellation under Regulation 2.1.8 (3), the Food Business Operator may make a fresh application for Registration or license to the concerned authority if all observations made in the improvement notice have been complied with.

I have pulses/grains milling unit. What kind of license do I need to obtain?
Pulses/Grains etc. milling unit comes under Manufacturing Kind of Business. These milling units exclusively covered under State License irrespective of their production capacity.
